Welcome to Kalemny! These Terms of Service ("Terms") govern your use of the Kalemny mobile application (the "App") operated by Kalemny Limited ("we," "our," or "us").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By accessing or using the App, you confirm that:

• You have read, understood, and agree to these Terms
• You are at least 13 years old (or have parental consent if under 13)
• You have the legal capacity to enter into this agreement
• You will comply with all applicable laws and regulations

2. Account Registration

2.1 Account Creation

To use certain features of the App, you must create an account by providing:

• A username
• A valid email address
• A password
• Your date of birth (for age verification)

2.2 Account Responsibility

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

2.3 Account Accuracy

You agree to:

• Provide accurate and complete information
• Update your information as necessary
• Not create multiple accounts
• Not impersonate others

2.4 Age Requirements

• Users must be at least 13 years old to create an account
• Users under 13 require verifiable parental consent
• We may terminate accounts that violate age requirements

3. Use of the App

3.1 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial educational purposes.

3.2 Restrictions

You agree NOT to:

• Copy, modify, or distribute the App or its content
• Reverse engineer, decompile, or disassemble the App
• Use the App for any illegal purpose
• Interfere with or disrupt the App's operation
• Attempt to gain unauthorized access to our systems
• Use automated tools, bots, or scrapers
• Remove any copyright or proprietary notices
• Sublicense or sell access to the App

4. User-Generated Content

4.1 Content You Create

When you create content (posts, comments) through the App:

• You retain ownership of your content
• You grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content in connection with the App
• You represent that your content does not violate any third-party rights

4.2 Community Guidelines

You agree NOT to post content that:

• Is offensive, abusive, harassing, or threatening
• Contains hate speech, discrimination, or promotes violence
• Is sexually explicit or inappropriate
• Infringes on intellectual property rights
• Contains spam, advertisements, or solicitations
• Impersonates others or is misleading
• Violates any applicable laws
• Contains personal information of others without consent

4.3 Content Moderation

We reserve the right to:

• Remove any content that violates these Terms
• Suspend or terminate accounts that violate our guidelines
• Report illegal content to appropriate authorities

5. Account Restrictions and Enforcement

5.1 Enforcement Philosophy

We believe in proportionate responses. Not every violation warrants the same action. We use a graduated enforcement system designed to be fair while protecting our community.

5.2 Types of Restrictions

Warnings: Formal notices for minor or first-time violations. Warnings remain on your account record.

Social Feature Restrictions ("Social Ban"): Temporary or permanent restriction from community features (posting, commenting, social interactions) while retaining access to learning content. Typically applied for:

• Harassment, bullying, or abusive behavior toward other users
• Spam, excessive self-promotion, or solicitation
• Posting inappropriate, offensive, or off-topic content
• Impersonation or misleading behavior
• Repeated minor violations after warnings

Full Account Suspension ("Account Ban"): Complete restriction from all App features, including learning content. Reserved for serious violations such as:

• Payment fraud, chargebacks, or financial abuse
• Sharing, selling, or unauthorized transfer of accounts
• Posting illegal content (including but not limited to child exploitation material, terrorism-related content, or content that violates applicable laws)
• Cheating, exploiting bugs, or gaming systems to gain unfair advantage
• Severe or repeated harassment after social restrictions
• Violations of age requirements (COPPA compliance)
• Any activity that poses legal liability to us or endangers other users

5.3 Enforcement Process

Before taking enforcement action, we generally:

1. Review the reported behavior or violation
2. Consider the severity and context of the violation
3. Review the user's history (prior warnings or restrictions)
4. Apply the least restrictive measure appropriate to the situation

For severe violations (illegal content, fraud, safety threats), we may take immediate action without prior warning.

5.4 Duration of Restrictions

• Warnings: Permanent record, no feature restriction
• Social Bans: May be temporary (24 hours to 30 days) or permanent, depending on severity
• Account Bans: May be temporary or permanent, depending on severity

5.5 Effect on Subscriptions

• Social Bans: Active subscriptions remain valid. You retain access to all learning features and content you have paid for.
• Account Bans: Access to all features, including paid content, is suspended. Refund eligibility is determined by the applicable app store policies and the nature of the violation. Bans resulting from fraud, illegal activity, or serious Terms violations are generally not eligible for refunds.

5.6 Appeals Process

If you believe a restriction was applied in error, you may appeal by:

1. Contacting us at support@kalemny.app within 30 days of the restriction
2. Providing your username and a clear explanation of why you believe the restriction should be reconsidered
3. Including any relevant context or evidence

We will review appeals and respond within 14 business days. Our decision on appeals is final.

5.7 Catch-All Provision

We reserve the right to take enforcement action for any behavior that, in our sole judgment, violates the spirit of these Terms, harms our community, damages our reputation, or creates legal liability—even if not explicitly listed above.

6. Intellectual Property

6.1 Our Content

The App and its content, including but not limited to text, graphics, logos, images, lesson content, educational materials, audio recordings, pronunciation guides, software, and user interface design, are owned by us or our licensors and protected by intellectual property laws.

6.2 Trademarks

"Kalemny" and our logos are our trademarks. You may not use them without our prior written consent.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

8. Subscriptions and Payments

8.1 Free and Premium Features

The App may offer both free and premium (paid) features.

8.2 Subscription Terms

If you purchase a subscription:

• Payment will be charged to your app store account
• Subscriptions automatically renew unless canceled
• You can manage subscriptions through your device settings

8.3 Refunds

Refund policies are governed by the applicable app store (Apple App Store or Google Play Store).

8.4 Price Changes

We may change subscription prices. Changes will be communicated in advance and will apply to subsequent billing periods.

9. AI Chatbot and Conversational Features

9.1 AI Disclosure

The App includes AI-powered chatbot and conversational features for language learning practice. BY USING THESE FEATURES, YOU ACKNOWLEDGE AND AGREE THAT:

• You are interacting with artificial intelligence (AI), NOT a human being
• The AI assistant is a computer program designed to simulate conversation for language practice
• The AI does not have consciousness, emotions, or personal opinions

9.2 Intended Use - Language Practice Only

The AI chatbot features are designed EXCLUSIVELY for Arabic language practice and learning. You agree to use these features only for:

• Practicing Arabic conversation skills
• Learning vocabulary and grammar in context
• Pronunciation practice
• Language comprehension exercises

9.3 Prohibited Uses of AI Features

You agree NOT to use the AI chatbot features for:

• Obtaining factual information, news, or current events
• Seeking medical, legal, financial, psychological, or any professional advice
• Making important life decisions
• Obtaining information that requires accuracy or reliability
• Any purpose other than language learning and practice

9.4 No Professional Advice

THE AI CHATBOT DOES NOT PROVIDE AND IS NOT INTENDED TO PROVIDE:

• Medical, health, or mental health advice
• Legal advice or opinions
• Financial or investment advice
• Professional advice of any kind
• Emergency services or crisis support

If you are experiencing a crisis or emergency, please contact appropriate emergency services in your area.

9.5 User Responsibility

You are solely responsible for:

• Verifying any information obtained through AI interactions with authoritative sources
• Understanding that AI responses are for language practice only
• Not relying on AI responses for decision-making
• Supervising minors' interactions with AI features

10. Disclaimers

10.1 No Guarantee

We do not guarantee that:

• The App will be uninterrupted or error-free
• Defects will be corrected
• The App will meet your specific requirements
• You will achieve specific learning outcomes
• AI-generated content will be accurate or appropriate

10.2 Educational Content

The App is designed to assist with Arabic language learning but:

• Is not a substitute for formal education or professional language instruction
• May contain errors or inaccuracies in AI-generated content
• Results may vary based on individual effort
• Should be supplemented with other learning resources

10.3 AI-Specific Disclaimers

WITH RESPECT TO AI FEATURES:

• We make no warranties regarding the accuracy, reliability, or appropriateness of AI-generated content
• We are not responsible for any decisions made based on AI-generated information
• We disclaim all liability for any harm resulting from reliance on AI-generated content
• The AI may produce different responses to the same input at different times

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your user-generated content
• Your misuse of AI features or reliance on AI-generated content

13. Termination

13.1 Termination by You

You may terminate your account at any time by:

• Deleting your account through the App settings
• Contacting us at support@kalemny.app

13.2 Termination by Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Abuse the App or other users
• Misuse AI features contrary to these Terms
• At our sole discretion for any reason

13.3 Effect of Termination

Upon termination:

• Your license to use the App ends
• Your access to the App will be revoked
• Certain provisions of these Terms survive termination

14. Dispute Resolution

14.1 Informal Resolution

Before filing a formal dispute, you agree to contact us and attempt to resolve the matter informally.

14.2 Governing Law

These Terms are governed by the laws of Hong Kong Special Administrative Region, without regard to conflict of law principles.

14.3 Arbitration

Any disputes shall be resolved through binding arbitration in accordance with the Hong Kong International Arbitration Centre rules, except where prohibited by law.

14.4 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class actions.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us.

15.2 Severability

If any provision is found unenforceable, the remaining provisions will continue in effect.

15.3 Waiver

Our failure to enforce any provision does not constitute a waiver of that provision.

15.4 Assignment

You may not assign these Terms without our consent. We may assign our rights and obligations freely.

15.5 Notices

We may provide notices through the App, email, or other reasonable means.

16. Changes to These Terms

We may modify these Terms at any time. Changes will be posted within the App with an updated "Last Updated" date.

Material changes will be communicated via in-app notification or email notification.

Your continued use of the App after changes constitutes acceptance of the updated Terms.

18. Special Provisions for Children and Minors

18.1 COPPA Compliance

For users under 13 years old:

• Parental consent is required
• Parents can review and request deletion of their child's data

• Supervising their child's use of the App
• Ensuring compliance with these Terms
• Managing their child's account settings
• Monitoring their child's interactions with AI features

18.3 AI Features and Minors

Parents should be aware that:

• AI chatbot features may generate content not suitable for all ages
• Parental supervision is recommended for AI chat interactions
• The AI is not designed to provide advice or guidance to minors
• We recommend discussing appropriate use with children before they use AI features

By using Kalemny, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
